Meta AI WhatsApp Investigation

Nine months after its implementation in Europe, Meta’s conversational artificial intelligence (AI) tool, integrated directly into WhatsApp, will be investigated by the European Commission .

Two officials from the Brussels institution told the British newspaper The Financial Times . The news has not yet been officially confirmed, but it could be in the coming days, according to the same sources.

Antitrust regulations at play

The government will have to determine whether Meta violated European antitrust regulations by integrating its artificial intelligence into its messaging service. Represented by a blue and purple circle in the app, this feature is described as “an optional Meta service that uses AI models to provide responses.”

The tool is used primarily to write messages to other users. It can also be used in conversations by mentioning “@MetaAI.”

Last March, Meta explained that it took “longer than expected” to implement this system in Europe due to its “complex European regulatory system .” “But we’re happy to have finally succeeded,” Mark Zuckerberg’s company stated, implying that it had carefully examined the implementation’s compliance with European Union competition rules . Now it’s up to investigators in Brussels to verify this.

A first investigation in Italy

In Italy, the Italian Competition Authority (Autorità Garante della Concorrenza e del Mercato) has been investigating this case since July . The aim is to determine whether Meta abused its dominant position by installing its artificial intelligence tool on WhatsApp without user consent , potentially harming its competitors.

Meta’s AI integration could indeed be seen as an unfair way to direct WhatsApp users to Meta’s AI service and thus “lock them” into its ecosystem.

The investigation is ongoing and was even expanded on Wednesday, November 26, as reported by British news agency Reuters . It now also concerns WhatsApp Business’s new terms of service, as well as the new artificial intelligence features integrated into the messaging app. According to Rome, these changes “could limit production, market access, or technical developments in the market for AI-based chatbot services.”
